Welcome to Bebran Digital ("Bebran, we, us, or our"). This website (au.bebran.com) and our digital marketing, SEO, and web development services are owned and operated by Bebran Digital Pvt. Ltd. By accessing our website or engaging our services, you enter into a binding agreement with Bebran Digital and agree to abide by these Terms and Conditions. If you do not agree with these terms, please do not use our website or services.
Australian Consumer Law: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the ACL, that cannot lawfully be excluded or limited.
Not every enquiry qualifies for a complimentary marketing plan or strategic audit. We may assess project fit, scope alignment, and client suitability before delivering custom marketing audits or free strategic roadmaps.
We are deeply committed to driving powerful, measurable growth for your business and will provide our services with due care and skill, using industry best practices and data-driven strategies. Because digital marketing ecosystems—such as search engine algorithms and advertising platform policies—are managed by third parties and evolve dynamically, specific keyword rankings, exact traffic volumes, or fixed revenue outcomes cannot be guaranteed. Instead, we view our partnership as a collaborative journey where we continuously test, optimise, and adapt together to achieve your highest long-term business potential.
Both parties agree not to make false, misleading, or defamatory statements about each other or their principals, agents, officers, owners, directors, or employees, whether during the active term of engagement or following termination. Nothing in this clause prevents either party from posting a truthful and genuine review of their experience, making a complaint to a regulator, or making truthful statements in connection with legal proceedings or regulatory investigations.
If a client fails to pay an invoice when due or to maintain active billing details, Bebran Digital may charge interest on the overdue amount at the rate stated in your service agreement, and may pause active campaigns, ad management, or client dashboard access after giving 7 days' written notice, until the outstanding amount is paid in full.
Subject to the Australian Consumer Law section above, and to the maximum extent permitted by law:
Neither party shall be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including natural disasters, bushfires, floods, pandemics, widespread utility or internet failures, industrial action, or government restrictions.
These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the courts that may hear appeals from them.
This document, together with any signed proposal or Statement of Work, constitutes the entire agreement between the parties regarding our website and services. If any provision of these Terms is found invalid, unfair, or unenforceable, it will be read down or severed, and the remaining provisions shall continue in full force and effect.
